This writ application has been filed for issuance of a direction to the respondent authorities to rectify the Jamabandi with respect to land of the petitioner pertaining to Khata No. 1006 Khesra No. 2578 Area 0.20 Acre situated in Mauza Dalan in Katihar Circle and further to set aside the recommendation made by the Circle Officer, Katihar (Respondent No. 5) vide its Letter No. 1270 dated 29.06.2022.
Operative part
Considering the facts and circumstances of the case, this writ petition is disposed of with liberty to the petitioner to file a fresh representation before the Additional Patna High Court CWJC No.8554 of 2023(2) dt.02-12-2023 Collector, Katihar (Respondent No. 3) with all the necessary documents in her support within a period of eight weeks from today.
In the event such representation is filed within the stipulated time frame, Respondent No. 3 is directed to dispose of the same in accordance with law, after hearing the parties, preferably, within a period of six months from the date of filing of such representation.
It goes without saying that if any question of limitation arises before the competent authority, the same shall be considered taking into consideration the fact that the petitioner was pursuing the issue before this Court under Article 226 of the Constitution of India.
