CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 29-03-2012 Heard learned counsels for the petitioner and the State. The petitioner being the co-villager of the deceased is apprehending his arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code. It is alleged that father of the informant sold some land to meet expenditures of treatment of his wife who is suffering from cancer which was not liked by brother’s wife of the informant hence it was suspected that the father of petitioner was being killed by daughter-in-law and others including the petitioner. It is submitted that during investigation accusation was found false and final form was submitted since there was no eye witness to the occurrence and subsequently on protest cognizance has been taken and other accused Munna Ram has been 2 Patna High Court Cr.Misc. No.9739 of 2012 (2) dt.29-03-2012 granted anticipatory bail vide Cr. Misc. No. 13217 of 2011 and Munni Devi has been granted regular bail vide Cr. Misc. No. 20988 of 2007 by this Court. Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Daniyawa P.S. Case No. 41 of 2011 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna City, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U.K./- (Dinesh Kumar Singh, J)
