Heard learned counsel for the parties. The petitioner seeks bail in a case which has been registered for offences under Sections 307,326 and some other Sections of the Indian Penal Code and 25(1- B),26,27 and 35 of the Arms Act. Allegation is that altogether 14 named accused and others fired upon the police party. Submission is that the petitioner is not named in the first information report and F.I.R. named co-accused have been granted bail by different orders of this Court. Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in Manihari P.S.Case No. 105 of 2007.
