JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 18-04-2012 Heard learned counsels for the petitioner, informant and the State. The petitioner being the Secretary of the middle school is apprehending arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code. The FIR was lodged against the headmaster of the school with accusation that Rs. 5,55,000/- were misappropriated with regard to construction of the school building. The petitioner was not named in the FIR. His name was subsequently surfaced during investigation. It is submitted by learned counsel for the petitioner that that the headmaster of the school has been granted anticipatory bail by the learned court below on accepting the letter dated
18.10.2011 issued by the B.D.O., Sahebpur addressing to the D.S.E., Begusarai that the headmaster has completed the work. Considering the aforesaid facts, let the above named Patna High Court Cr.Misc. No.14127 of 2012 (2) dt.18-04-2012 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S. Case No. 103 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C. Amrendra/- (Dinesh Kumar Singh, J)
