JUSTICE MOHIT KUMAR SHAH : 7 27-02-2023 The present writ petition has been filed ORAL ORDER seeking the following reliefs:- 1(i). For quashing the undated notice issued under the signature of Circle Officer, Bodhgaya under Section 3 of Bihar Public Land Encroachment Act, 1956 hereinafter referred as Act, 1956 in Case No. 39/13-14, 31/13-14, 32/13- 14, 33/13-14, 34/13-14, 35/13-14, 36/13-14, 37/13- 14, 38/13-14, 40/13- 14, 41/13-14, 42/13-14, 44/13-14, 45/13-14, 46/13-14, 47/13-14, 48/13- 14, 49/13-14, 50/13-14, 51/13-14, 52/13-14, 53/13-14, 54/13-14, 55/13- 14, 56/13-14, 57/13-14, 58/13-14, 59/13-14, 60/13-14, 61/13-14, 62/13- 14, 63/13-14, 64/13-14, 65/13-14, 66/13-14, 67/13-14, 68/13-14, 70/13- 14, 71/13-14, 72/13-14 and 73/13-14 respectively as contained in Annexure- 2 series. By which the petitioners have Patna High Court CWJC No.17510 of 2013(7) dt.27-02-2023 been asked show cause as to why encroachment made on Khata No. 509, Plot No. 1514 be not removed and if the petitioners do not appear on

08.08.2013 it will be assumed that the petitioners have to say nothing and ex parte decision shall be taken. (ii). Also for quashing the notice as contained in Annexure-4 which relates to the petitioners issued under Section 6(2) of the Bihar Act 1950 issued under Section 6(2) of the Act 1956 against Mahanth Sudarsan Giri on

10.08.2013 by which direction has been given to the Mahanth Sudarsan Giri to remove encroachment by

26.08.2013 over Khata No. 507,509, Plot No. 1511,1513,1514 and 1516 which also cover the land over which shops of the petitioners which has been rented by Bodhgaya Math failing which appropriate action under Section 188 Cr.P.C. shall be taken against Mahanth Sudarsan Giri. (iii). Also for directing the respondents concerned specially Circle Officer, Bodhgaya to not remove the structure of shops which has been rented by landlord Bodhgaya Math Neyas Patna High Court CWJC No.17510 of 2013(7) dt.27-02-2023 Samitee through its Mahanth Sudarsan Giri to run the shops over the land mentioned in the notice as contained in Annexure-2 series respectively and Annexure-4. (iv). Also for directing the respondents to not remove the structure of the shops of the petitioners for how long. encroachment case instituted against the petitioners as mentioned in the notice as contained in Annexure-2 series and 4 are pending before the Circle Officer, Bodhgaya. At the outset, the learned counsel for the petitioners submits that the petitioners be granted liberty to challenge the final order, passed under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 by the Circle Officer, Bodh Gaya, Gaya, by filing appropriate appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956. Liberty, so sought, is granted. It is needless to state that in case, appropriate appeal is filed within a period of four weeks from today, the appellate authority shall consider the same on merits, without being Patna High Court CWJC No.17510 of 2013(7) dt.27-02-2023 impeded by the issue of limitation and pass a reasoned and a speaking order, in accordance with law, upon also taking into account all the issues to be raised by the petitioners in the appeal, including that of them having right, title and interest in the property apart from considering the various orders passed by this Court and till the final order is passed, status quo, existing as on today qua the shops / premises of the petitioners in question, shall be maintained.
