====================================================== Appearance : For the Petitioner/s : For the Opposite Party/s : ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA Mr. Arjun Prasad, Advocate Mr. Anant Kumar No.1 APP ORAL ORDER 15 21-11-2022 Heard learned counsel for the petitioner and the learned APP for the State. Learned counsel for the petitioner submits that having considered the merits of the case, a Co-ordinate Bench of this Court has been pleased to grant provisional bail to this petitioner till disposal of the case and certain reports were called for from the different authorities of the State Government. From perusal of record especially the order dated
24.06.2022 of the learned Co-ordinate Bench, it appears that though various reports, kept on record, have been filed by the State, still some reports were awaited. The learned Co-ordinate Bench adjourned the matter at the request of learned counsel for the State who prayed for grant of some time to ensure the Patna High Court CR. MISC. No.39706 of 2021(15) dt.21-11-2022 compliance of the order of this Court in letter and spirit. Since, it is a petition under Section 439 and 440 of Cr.P.C., I do not find any useful purpose would be served in keeping the matter pending for filing of the report by the authorities of the State. Hence, the provisional bail granted to the petitioner vide order dated 19.05.2022, in connection with Mufassil P.S. Case No. 255 of 2018, is hereby confirmed. Ashish/- U T (Arun Kumar Jha, J)
