… … Respondents For the petitioner: Shri Onkar Nath, Adv. For the State: Shri G.K.Agrawal, G.P.I -----------
22.11.2010 This application has been filed for quashing the order of detention dated
26.8.2010 passed District Magistrate, Lakhisarai under Section 12(2) of the Bihar Control of Crimes Act, 1981. The detention order has been challenged on several grounds. Today, a counter affidavit on behalf of respondent no.5 has been filed stating that the detention order passed by the District Magistrate, Lakhisarai under Section 12(2) of the Bihar Control of Crimes Act has not been confirmed by the State Government under Section 21(2) of the Act and as such the order has been passed 2 for releasing the petitioner. Considering these facts, the writ application has become infructuous. It is dismissed as such. Kanth ( Mridula Mishra, J.) ( Dharnidhar Jha, J.)
