JUSTICE NAVIN SINHA) 17 16-08-2013 We have heard counsel for the petitioners and the State. The Court had ordered that the petitioners were appointed on temporary posts. Directions were given to restore the petitioners on the post in the same status they held on 31.1.2008, the date of termination. Learned counsel for the petitioners contended that though reinstatement has been done, but not on the same pay scale they were drawing on 31.1.2008. This was disobedience of the directions given by the Court. The supplementary show cause was itself evidence that the petitioners were not being paid the correct scale. It was lastly submitted that the reinstatement has not been done from 31.1.2008 as ordered. Learned Additional Advocate General No. 2 7 Patna High Court MJC No.1278 of 2008 (17) dt.16-08-2013 7 / 9 submitted that the petitioners have been reinstated in the same status as on 31.1.2008 with revised pay scale. There was no direction for retrospective reinstatement, except for the purpose of seniority while considering regularization. We have gone through the orders passed in M.J.C. No. 1278 of 2008 and M.J.C. No. 1603 of 2012. The order dated 30.4.2013 in M.J.C. No. 1278 of 2008 reads as follows:- “There appears to be a the in controversy interpretation of the directions issued by the Bench in L.P.A. No. 322 of 2008 and analogous matters. respect of Let the petitions be placed before the Bench of which Hon’ble Mr. Justice Vikash Jain is a member.” The order dated 28.6.2012 in M.J.C. No. 1603 of 2012 reads as follows:- “The only grievance of the petitioners worth considering at this stage is that they should be paid their due salary as per order of the Division Bench if they have been reinstated and they are working………” The order dated 19.7.2012 reads as follows:- “ If the grievance of the petitioners that their salaries are not being paid in spite of joining their posts long back in the month of March, 2012, is not redressed by the next date, then opposite party no. 2, Acting Secretary, Bihar Legislative Assembly and Deputy Secretary (Establishment) should be present in Court on the next date……” The order dated 30.8.2012 reads as follows:- 8 Patna High Court MJC No.1278 of 2008 (17) dt.16-08-2013 8 / 9 “It appears that salary is now being paid to most of the concerned employees and only in cases of four persons payment has not been resumed due to technical difficulties on account of non-availability of G.P.F. account. For them a solution is being found out. As prayed on behalf of the State, let this matter be listed under the same heading after two weeks. In case the petitioners are being paid lesser amount to what they were getting on 31.1.2008 then the authorities will be well advised to make necessary correction and ensure that they do not get lesser payment to what they were getting on 31.1.2008.” The order dated 11.10.2012 reads as follows:- of “On behalf the Legislative Assembly, it is admitted that the Assembly has not only withheld arrears of salary which it could do in view of the order of the Division Bench order but it has also refused to allow the increments for the period concerned although increments have been earned by others and there was a direction of the Division Bench as well as writ Court that petitioners’ shall be restored. status The only conclusion possible from the words of the Division Bench or the writ Court is that the Assembly can only withhold payment of arrears of salary but calculation of salary shall be done in the same manner as was required to be done at the time when the status was disturbed. In other words, there is no order that there of be shall increments…..” forfeiture We find that the order in the L.P.A. did not contain any specific directions with regard to reckoning of pay scale by addition of increments. In absence of any specific 9 Patna High Court MJC No.1278 of 2008 (17) dt.16-08-2013 9 / 9 direction, we find it difficult to hold the opposite parties answerable in contempt. The increments are a matter of further enquiry, calculations etc. The opposite parties have issued an order on 24.7.2012, inter alia that in case of any arrears in the pay scale, not only recovery be made but also the amount paid less would be paid to the aggrieved. In the entirety of the discussion, more particularly, the order dated 30.4.2013 in M.J.C. No. 1278 of 2008 that there appeared a controversy with regard to different interpretations of the order requiring clarification, we are satisfied that if there be any ambiguity in the order of which non compliance is alleged, it is difficult for us to proceed further in the contempt jurisdiction. If the petitioners represent for any grievance regarding the inappropriate pay scale, it is expected that the opposite parties shall consider it in accordance with law. No orders need be passed on any I.A. applications filed on behalf of the opposite parties. The applications stand disposed. (Navin Sinha, J) (Vikash Jain, J) P. Kumar/-
