(ii) For quashing the order No. 44(Bi)/2006 issued under the signature of the Deputy Secretary (SR), Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions, Govt. of India (respondent no.11) as contained in Annexure 3, whereby and whereunder the services of the petitioner had been finally allocated to Bihar State despite his option having been submitted for Jharkhand State.” while this Court is of the considered opinion that the order of the Central Government dated 2.8.2006, as contained in Annexure 3, in exercise of its power under section 72 of the Bihar Re- organization Act does not suffer from any infirmity and thus, the prayer for its being quashed after more than six years of its being passed and acted upon is wholly unreasonable and must be accordingly rejected. In the counter affidavit which has been filed on behalf of Patna High Court CWJC No.14244 of 2012 (2) dt.21-01-2013 5 the State of Bihar it has been clearly mentioned that the application of the petitioner was already forwarded by the Govt. of Bihar to the Govt. of Jharkhand seeking recommendation of the Govt. of Jharkhand and in fact the State Govt. of Bihar also by its separate letter dated 3.8.2010 had given its consent for handing over the services of the petitioner to the State of Jharkhand. There is, however, nothing on record to show as to what action has been taken by the State of Jharkhand on such recommendation made by the State of Bihar as stated in its counter affidavit. In fact the learned counsel for State of Jharkhand has not filed any counter affidavit in a period of more than five months of filing of the writ application. Mr. N.A.Shamshi, learned Assistant Solicitor General, appearing for the Govt. of India, has however assured this Court that if the Govt. of Bihar and the Govt. of Jharkhand will give its no objection for transfer of the petitioner from Bihar cadre to Jharkhand cadre by way of re-allocation of his service in terms of Section 72 of the Bihar Re-organization Act, the Central Government being the final authority will take its appropriate decision within a period of six months from the date of receipt of such recommendation from the State of Jharkhand. Considering the fact that the petitioner has himself Patna High Court CWJC No.14244 of 2012 (2) dt.21-01-2013 6 consented to forego his earlier seniority and also to abide by all the other terms and conditions as specifically enumerated in Annexure 4, the press communication by the Govt. of Bihar, this Court hopes and believes that if the Govt. of Bihar and the Govt. of Jharkhand have already given their no objection for re- allocation of the service from the State of Bihar to State of Jharkhand, the Central Government shall also take its decision and pass an appropriate order within a period of six months from the date of receipt of such recommendation.
