JUSTICE ASHWANI KUMAR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 4 07-10-2013 This Appeal under Clause 10 of the Letters Patent has been preferred by the writ petitioners against the order dated 28th October 2009 made by the learned single Judge in CWJC No. 13005 of 2009. The appellants-writ petitioners had applied for selection and appointment as Police Sub Inspectors pursuant to the Patna High Court LPA No.824 of 2013 (4) dt.07-10-2013 7/8 Advertisement nos. 1, 2 & 3 of 2004. Evidently, the petitioners were the persons who were not selected as Police Sub Inspectors. Their claim for selection and appointment made in the above CWJC No. 13005 of 2009 came to be rejected by the learned single Judge under the impugned order dated 28th October 2009. According to the learned single Judge, the petition was cryptic and bereft of necessary facts and pleadings. The learned single Judge dismissed the Writ Petition on the premise that no person below the appellants in the merit list was appointed as Police Sub Inspector. The Court refused to start roving enquiry at the behest of the appellants. The said order has been challenged in the present Letters Patent Appeal after more than three years. The appellants have filed Interlocutory Application No. 4745 of 2013 under Section 5 of the Limitation Act for condonation of the aforesaid delay 3 years and 112 days. The only reason recorded in the application is that the appellants were not aware of the impugned order dated 28th October 2009 and that they had become wiser by a newspaper report dated 21st February 2013. The aforesaid newspaper report is not brought on the record. The mere statement that they were not aware of the order is not believable. It appears that the petitioners are encouraged to bring this Appeal on account of some other order made in some other Writ Petition which too is not disclosed in this Appeal or the Interlocutory Application. Be that as it may, neither there is any cause, much less a sufficient cause for the delay which may be condoned in exercise of power conferred by Section 5 of the Limitation Act; nor do we find any merit in the Appeal. In any view of the matter, the appellants cannot seek employment in 2013 on the basis of the Patna High Court LPA No.824 of 2013 (4) dt.07-10-2013 8/8 selection process initiated in 2004 and completed in 2008 (as recorded by the learned single Judge). The Appeal is clearly an afterthought. Letters Patent Appeal and Interlocutory Application No. 4745 of 2013 are rejected. (R.M. Doshit, CJ) (Ashwani Kumar Singh, J) Dilip.
