JUSTICE MIHIR KUMAR JHA ORAL ORDER 2 12-09-2013 Heard learned counsel for the parties. If the petitioners want that their departmental proceeding should not be conducted during the pendency of the criminal case they will have to bring this fact to the notice of the appointing authority for staying the departmental proceeding. When this observation has been made Mr. Chittranjan Sinha, learned Senior Counsel appearing on behalf of the petitioners, has sought permission to withdraw all these applications in order to enable the petitioners to move the competent authority for considering the prayer of the petitioners for stay of the departmental proceeding. All these applications are, accordingly, permitted to be withdrawn with the aforementioned liberty but at the same time it is made clear that this Court has expressed no opinion on the merits of the claim of the petitioners.
