The grievance of the petitioner, in this writ application, is with regard to the preparation of panel for selection on the post of Physical Trained Teachers in the Secondary Schools as per the Bihar Nagar Nikay Madhyamik Evam Uchtar Madhyamik Shikshak (Niyojan Evam Seva Shaten) Niyamawali, 2006 (hereinafter referred to as the Rules).

Learned counsel for the petitioner has submitted that since the petitioner is holding the qualification of bachelor in Physical Education, a degree course, and has also completed the Diploma Course in Bachelor of Physical Education, he will be not only fulfilling the requirement of the post of Physical Trained teacher but would also be entitled to for the 5 weightage points 2 2 / 6 inasmuch as in none of the Colleges conducting the Physical Education Course there is any special course for honours in Physical education. Learned counsel for the State, on the other hand, having placed reliance on the Rules and Specially Rule 4, has submitted that neither the petitioner possesses the requisite qualification for the post of Physical trained teacher nor there would be any concept of giving weightage for Honours to the persons like the petitioner. In order to appreciate the afore mentioned submissions it will be necessary to first take into account as to the qualification which has been laid down for the post of Physical trained teacher. In the case of a Teacher for Physical Training such requirement is to be fulfilled by being both a grade 4 4 / 6 and also having degree in the physical education. The petitioner, admittedly, claims to fulfil the first degree of graduation on the basis of his three years’ degree course of Bachelor in Physical education which he describes as Bachelor of Physical Education. Assuming though not accepting that the petitioner, on the basis of that will fulfil the requirement of Rule 4(iv) (ka), the petitioner will have to also satisfy the requirement of Rule 4(iv)(kha). As noted above, a person has to possess either of two degree of qualification for Physical Education but the petitioner does not possess that because he has passed only one year’s course. There is infact nothing on record to show that this one year course of Physical Education is a degree course. In any view of the matter, the one year degree course said to have been completed by the petitioner from Sant Gadge Baba Amrawati University, Amrawati, could be treated to be a qualification to a degree only if the NCTE had also made such degree of one year in physical education equivalent to a degree course as prescribed in Rule 4 (iv) (ka). The problem for the petitioner infact does not end here inasmuch as in this writ petition he also claims weightage of five points. In fact once there is also provision for considering the cases for untrained teacher in Rule-6, the requirement of qualification in Rule 4(iv) (Ka) and (Kha) prescribed for teachers of Physical Education will itself rule out the prospect of applicability of Rule 6 for the post of Teacher of 6 6 / 6 Physical Education. In that view of the matter, no physical trained teacher would be entitled to for grant of weightage for Honours and the petitioner should also, therefore, be not worried about his being allegedly treated in a discriminatory manner.
