Case at a glance
Provisions considered
Judgment
No one appears on behalf of the petitioner. Mr. Rajendra Narayan is appearing on behalf of the opposite parties. Perused the order. The approach of the Court below in directing payment of rent in view of the findings as with regard to their relationship of landlord and tenant as also no dispute with regard to the quantum of the amount of last rent paid, does not leave any scope for this Court to interfere under Section 115 of the Code of Civil Procedure. At this stage also, Mr. Narayan states that the evidence in this eviction suit has already been completed and in fact arguments also have been concluded and now the case is only awaiting the delivery of judgment. In that view of the matter, if the aforementioned facts are correct, the Court below will proceed to deliver the judgment within a period of six weeks from the date of receipt/production of a copy of this order. Accordingly, there being no merit in this civil revision application, the same is hereby dismissed. Rsh (Mihir Kumar Jha, J.)
