1.9.2008 Heard learned counsel for the parties. The petitioner has approached this Court for quashing the letter dated 19.5.2008 as also notice dated 24.7.2008 issued by the Block Development Officer, Sangrampur, East Champararan, by which a special meeting for considering “ No Confidence Motion” had been fixed on 2.8.2008 at 11 A.M. In the counter affidavit filed on behalf of Respondent Nos. 5 to 14, an order dated 6.8.2008 passed by the District Magistrate, East Champaran, Motihari in exercise of power under Section 157 of the Bihar Panchayat Raj Act, 2006 has been brought on the record, by which he has held that the procedure as per the said Act had not been followed while convening the special meeting dated 2.8.2008 and, accordingly, he has declared the said meeting as illegal and has quashed the proceedings of the said meeting. In the aforesaid circumstances, nothing remains to be considered by this Court in the present writ application. The writ application is, accordingly, dismissed as infructuous.
