18.07.2008 Heard the learned Counsel for the petitioner and the learned Counsel for the State. When the matter is taken up prayer for adjournment is made to file counter affidavit. the Court is not persuaded to grant such adjournment any more. The petitioner was appointed on a Grade IV post. His claim is for promotion to a Grade III post with effect from 19.1.1988. To sup0port the contention reliance is placed on Annexure 19, an order dated 11.1.1997 granting such promotion to persons similarly situated to invoke Article 14 of the Constitution of India. The writ application is disposed with direction to the respondents to decide the claim of promotion of the petitioner in accordance with law within a maximum period of three months from the date of receipt and/or production of a copy of this order. If the respondents propose to pass an order prejudicial to the petitioner they shall be required to pass a reasoned and speaking order. Snkumar/- (Navin Sinha,J.)
