JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 5 Patna High Court SA No.555 of 2009 (13) dt.09-01-2013 12 09-01-2013 Heard Mr. Amit Kumar Rakesh, learned counsel for the appellants. The present appeal under section 100 of the Code of Civil Procedure has been placed for hearing under Order 41 Rule 11 C.P.C. The appeal has been preferred against the judgment and decree dated 8-9-2009 passed by learned 3rd. Additional District and Sessions Judge, Siwan in Title Appeal No. 27/83/20/2009 whereby he has affirmed the judgment and decree dated 14-1- 1983 passed by learned Ist. Munsif, Siwan in Title Suit No. 178/1972, which was filed for declaration of title and confirmation of possession of the plaintiffs over the suit land with a further relief that the defendants be restrained from interfering with peaceful possession of the disputed land by way of permanent injunction. The trial court decreed the suit in part in favour of the plaintiffs holding in respect of plot nos. 397,306, 308 and 311; total admeasuring area 5 katha 3 dhurs on contest against the contesting defendants and exparte against rest major defendants and dismissed the suit against the minor defendants. Learned counsel appearing for the appellants has not been able to point out any perversity in the findings of the court below. The only question which has been raised in course of hearing the present 6 Patna High Court SA No.555 of 2009 (13) dt.09-01-2013 appeal is that the suit before the court below was barred by the principle of res-judicata. On going through the orders of the court below particularly the order of the learned Ist. Appellate Court I find that the issue was duly considered in paragraph-8 and the findings of the court below do not warrant any interference. As I do not find any substantial question of law involved in this appeal, the appeal is accordingly dismissed. (Chakradhari Sharan Singh, J) Naresh/-
