JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 17-04-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code. The FIR was lodged against unknown when the informant’s vehicle was robbed. The name of the petitioner sprang up on the confession of co-accused. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and a statement has been made in para 8 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the Patna High Court Cr.Misc. No.10239 of 2013 (2) dt.17-04-2013 satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 185 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioner shall be accepted on filing affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. The said affidavit will be transmitted to the I.O., concerned. The non- co-operation of the petitioner in the investigation will give liberty to the prosecution to file an application for cancellation of the bail of the petitioner.
