JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 01-03-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 201/34 and 302 of the Indian Penal Code. It is alleged that the younger brother of the informant went in the company of the accused persons to participate in marriage when initially the informant was informed that Auto rickshaw fell in the Ganges and thereafter the informant was informed that his brother drowned in the Ganges. It is submitted by learned counsel for the 2 Patna High Court Cr.Misc. No.44095 of 2012 (3) dt.01-03-2013 petitioners that the accusation is not specific and on circumstantial evidence, accusation has been levelled when it is submitted by learned A.P.P. that the independent witnesses suggested that the victim jumped from the boat in the river while he was in intoxicated condition when his friend tried to save him. Considering the circumstantial nature of accusation, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Gardanibagh P.S. Case No. 133 of 2012 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U.K./- (Dinesh Kumar Singh, J)
