JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 9 22-08-2013 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the respondents. This is an application for setting aside the order dated 17.05.2011 passed in Title Suit No. 92/2003 by learned Munsif-II, Chapra whereby he has rejected an application filed by the Patna High Court CWJC No.10752 of 2011 (9) dt.22-08-2013 3/5 petitioners for marking original registered sale deed dated 20.10.1948 as an exhibit. Petitioners also prayed for directing the court below to allow another application of the same date for appointment of Finger Print Expert/ Hand Writing Expert. The petitioners are the plaintiffs in the title suit No. 92/2003 in which a decree of permanent injunction against the defendants/ respondents has been sought for. It appears that, after evidence of the parties were closed, the plaintiff/ petitioners filed two applications dated 03.05.2011 to the effect that registered sale deed dated 20.10.1948 was obtained in respect of the disputed land executed by Brij Nandan Prasad and Rama Prasad. They contended that whereas the defendants were claiming their title over the lands on the basis of Sada sale deed dated 05.01.1962 having an area of 4 katha 17 dhurs for consideration amount of Rs. 95, the claim of the petitioners/ plaintiffs was confined to only one katha. The said application, however, came to be rejected by the court below. Learned counsel for the petitioners submits that the said document, i.e. the registered sale deed dated 20.10.1948 is a crucial evidence for determination of the real question in controversy and the court below, in view of the nature of the document, ought to have allowed the application for exhibiting the Patna High Court CWJC No.10752 of 2011 (9) dt.22-08-2013 4/5 same. Learned counsel for the respondents, on the other hand, submits that the case is pending before the court below for final adjudication as evidence of both the parties are complete and the petitioners are trying to linger the suit. He, however, does not dispute the relevance of the said registered deed dated 20.10.1948, if genuine, for the purpose of just decision in the case. In the given facts and circumstances of the case and in view of rival submissions made on behalf of the parties, I am of the view that, keeping in mind the nature of the evidence, the petitioners wanted to bring on record the same, by way of exhibit, the court below should not have rejected such prayer. In view of above, I direct the court below to mark the said original registered sale deed dated 20.10.1948 as an exhibit and consider the petitioners other application dated 03.05.2011 for appointment of Finger Print Expert/ Hand Writing Expert for comparison of handwriting / finger print. The impugned order dated 17.05.2011 passed by learned Munsif-II, Chapra in T. S. No. 92/03 is set aside. This order, however, will be subject to payment of cost of Rs. 1000/- by the petitioners to the defendants in the court below within one month from today. As the suit has remained pending for a considerable Patna High Court CWJC No.10752 of 2011 (9) dt.22-08-2013 5/5 time, after closure of evidence, I observe that the court below shall expedite disposal of the same and not grant unnecessary adjournment to the parties.
