JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 26 06-02-2013 At the very first instance, this Court must record that these writ applications have dragged on for more than six years. The Court recognizes the State of Bihar as one entity and is not required to push, nudge or compel various departments to take decisions by issuing directives each time. Enough time has been wasted by granting indulgence to the State in the past. Now, time for a decisive decision making has come, which must be reached before the next date. The Court may not be satisfied with the time frame, which has been prayed for, however, as a last indulgence, whatever exercise is required to be done must be done after going into the order of the Hon’ble Apex Court. Whether it has any reflection or not on the issue raised in the present writ applications Patna High Court CWJC No.10179 of 2007 (26) dt.06-02-2013 or it is only a smokescreen to delay the matter will be tested subsequently. As of today, IA No.924 of 2013 is allowed with a clear direction to one and all, including the Chief Secretary of the State that whichever department has to take a decision, it must be done in unison. No separate affidavits are required to be filed explaining the reason for not taking a final decision on the issue. Matter will be listed for admission on 6th of May, 2013, for further consideration.
