07.07.2009 Petitioners have filed this application for directing the respondent authorities to consider their cases for selection of Panchayat/Prakhand Teachers as per Bihar Panchayat Primary Teacher (Employment and Service Conditions) (Amended) Rule, 2008. Petitioners have completed their teachers training from Gandhi Hindi Vidyapitha, Prayag, Allahabad (Uttar Pradesh). The case is - 6 - that the teachers training course was completed prior to coming into force N.C.T.E. Act. Petitioner’s grievance is that the State Government without holding enquiry regarding recognition of the institution namely Gandhi Hindi Vidyapitha, Prayag, Allahabad, has put the institution in the list of unrecognized institutions. Due to such decision of the State Government petitioners’ candidature for appointment as trained teachers is not being considered. I find that cases of similarly situated persons has been decided in C.W. J.C. No. 1387 of 2007 and analogous cases, by order dated

21.5.2007, directing the respondent authorities that before classifying any institution as fake and unrecognized institution proper inquiry should be made, reasons should be assigned in support of the decision, making documentary evidences in support of such decision known to the persons who are going to be affected on account of such decision. Persons affected like petitioners should also be given liberty to produce materials, documents and evidences in support of their claim that institution is not a fake institution, Respondents thereafter, only on consideration of the entire materials should pass a reasoned order. This application is being disposed of in terms of the earlier decision. The respondent authorities may follow same procedure as directed in C.W.J.C. No. 1387 of 2007, before rejecting the claim of petitioners for being considered for selection on the post of Panchayat Teachers. The case of the petitioner should also be decided along with the cases of other similarly situated persons by the same authorities. In case decision is in favour of petitioners, liberty should be given to them for participating in the - 7 - selection process of appointment.
