18.10.2005, as contained in Annexure 5, deleting the name of the petitioner from the voter list is an appealable order in terms of section 24 of the Representation of People Act, 1950 which provides an appeal before the Chief Electoral Officer. Mr. Sinha in fact would contend that the order passed by the Anchal Adhikari cum Assistant Electoral Officer has been passed in a slip-shod manner and the nine petitioners to this writ application could not file the most relevant documents which consideration by the appellate authority. In view of the fact that this writ application has remained pending in this Court from 6.12.2005 while this Court would accord leave to the petitioners to file an 2 appeal by directing the Chief Electoral Officer to decide the same on merits, it would also give liberty to the petitioner to rely on any further document which must be enclosed with the Memo of Appeal. Such Memo of Appeal, if filed within a period of four weeks, must be decided within a period of six months. With aforementioned observation, this application is disposed of.
