JUSTICE AKHILESH CHANDRA ORAL ORDER 3 22-11-2013 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State, who is armed with carbon/xerox copy of the case diary. The petitioners, who are apprehending their arrest connection with a case registered for the offence punishable under Sections 302, 307, 323, 341, 149 and 148 of the Indian Penal Code, are named accused in this case with allegation of killing the informant’s father, who had been absconding in another case. Submission is of false implication and there is vague and general allegation against the petitioners. Further, the police after investigation finding no material against the petitioners submitted final form, but taking a different note, cognizance has been taken. Considering the facts and circumstances of the case, in the event of petitioners abovenamed carry no criminal antecedent, in the event of their arrest or surrender before the court below within four weeks, let the petitioners abovenamed be enlarged on bail on furnishing bail bonds of Patna High Court Cr.Misc. No.18843 of 2013 (3) dt.22-11-2013 2 Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Chakai P.S. Case No. 63 of 2012, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
