In all these cases, the prayer of the respective petitioners is for release of the respective vehicles seized in connection with different cases registered under the various provisions of the Bihar Prohibition and Excise Act, 2016 (for Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 short ‘the Act of 2016’).

3. It would be pertinent to note here that Section 56 of the Act of 2016 provides for confiscation of the properties including vehicle whenever an offence is committed under the Act of 2016.

4. Section 58 of the Act of 2016 confers power upon the District Collector for confiscation whenever anything is seized or detained under the provisions of the Act of 2016.

5. Sub-clause (1) of Section 58 of the aforesaid Act provides that notwithstanding anything contained in this Act or any other law for the time being in force, where anything liable for confiscation under this Act is seized or detained under the provisions of this Act, the officer seizing and detaining such property shall, without any reasonable delay submit a report to the District Collector who has jurisdiction over the said area.

6. Sub-clause (2) of Section 58 of the aforesaid Act provides that the District Collector, if satisfied that an offence under this Act has been committed, may, whether or not prosecution is instituted for the commission of such an offence and whether or not a case is pending before any court, order confiscation of such property.

7. Sub-clause (3) of Section 58 of the aforesaid Act Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 provides that the Collector shall, before passing an order under sub-section (2), give a reasonable opportunity to the person concerned, of being heard.

8. Sub-clause (4) of Section 58 of the aforesaid Act provides that while making an order of confiscation under sub- section (2), the District Collector may also order that such of the properties which the order of confiscation relates, which in his opinion cannot be preserved or are not fit for human consumption, be destroyed. Whenever any confiscated article has to be destroyed in conformity with the provisions of the Act of 2016, it shall be destroyed in the presence of Executive Magistrate or officer ordering the confiscation or forfeiture, as the case may be, or in the presence of the Excise Officer not below the rank of a Sub-Inspector.

9. Sub-clause (5) of Section 58 of the aforesaid Act provides that while making an order of confiscation under sub- section (2), if the District Collector is of the opinion that it is expedient in the public interest to do so, he may order the said property or any part thereof to be sold by public auction or dispose of departmentally and proceeds deposited with the State Government.

10. Sub-clause (6) of Section 58 of the aforesaid Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 Act provides that the District Collector shall submit a full report of all particulars of confiscation to the Commissioner of Excise within one month of such confiscation.

11. Section 60 of the aforesaid Act provides that whenever any liquor, material, still, utensil, implements or apparatus or any receptacle, package, any animal cart, vessel, or other conveyance used in committing any offence, is seized or detained under this Act, no court shall have, notwithstanding anything to the contrary contained in any other law for the time being in force, jurisdiction to make any order with regard to such property.

12. Section 61 of the aforesaid Act provides that when an order for confiscation of any property has been passed under Section 58 and such order has become final in respect of the whole or any portion of such property, such property or portion thereof, as the case may be, shall vest with the State Government free from any encumbrance.

13. Thus, a conjoint reading of the aforesaid provisions would make it evident that under Section 58, the Collector has been vested with the power to confiscate any vehicle used in committing any offence under the Act of 2016, which has been detained or seized by the seizing officer. Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 However, before confiscating any vehicle, he has to initiate a proceeding on receipt of information regarding seizure or detention from the seizing officer. He is also required to give a reasonable opportunity of hearing to the person concerned before passing an order of confiscation of any property. The pre- requisite for passing an order of confiscation of a vehicle or any other property by the Collector is that he must be satisfied that an offence under the Act of 2016 has been committed. The Collector has not only been vested with the power to pass an order of confiscation, but if he is of the opinion that it is expedient in the public interest, he may also order the said property to be sold by public auction. Section 60 of the Act of 2016 bars jurisdiction of the court in making any order with regard to any property seized or detained under the Act used in committing any offence under the Act of 2016. Once an order of confiscation is passed, section 61 mandates that the property confiscated shall vest with the State Government free from any encumbrance.

14. Confiscation of property is, thus, the permanent deprivation of property by order of the confiscating authority. The procedures prescribed under the Act of 2016 have the potential to transfer the ownership of the property including Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 vehicle to the State. The persons or entities that owned that property at the time of confiscation lose all rights to the confiscated properties.

15. The object of confiscation of assets or property is to prevent and combat an organized crime and illicitly funded investments.

16. Since the provisions of the Act of 2016 whereby property of a person may be confiscated have serious consequences, the procedures prescribed therein are required to be scrupulously followed.

17. An argument has been advanced on behalf of the petitioners in most of the cases after the seizure of the vehicles, the Collector concerned has not initiated any proceeding, but in view of the bar under Section 60 of the Act of 2016, the concerned Special Judge is also not entertaining any application for release of the vehicle seized in connection with the offences under the Act of 2016. It has been submitted by them that in absence of initiation of confiscation proceeding by the Collector, the seized vehicle cannot be allowed to be detained in custody of the police. According to the petitioners, there is no forum where the owners of the vehicle may file their application for release of their respective vehicles. Therefore, Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 they have filed writ petitions before this Court seeking release of their respective vehicles.

18. Mr. Vivek Prasad, Mr. Kumar Manish and Mr. Vikas Kumar, learned counsel appearing for the State have prayed for three weeks’ time in order to enable them to seek instructions and file counter affidavit.

19. The prayer is allowed.

20. List these matters again under the same heading on 13th of January, 2020.

21. In the meantime, the State shall be required to file its counter affidavit in each case specifically answering in para 4 the following:- (a) Whether or not the officer seizing and detaining the vehicle in question has submitted a report to the District Collector having jurisdiction over the said area? (b) If the officer seizing and detaining the vehicle concerned has submitted a report to the District Collector, whether or not the District Collector having jurisdiction over the said area has initiated a confiscation proceeding and issued show cause notice to the registered owner/claimant of the vehicle concerned? (c) If a show cause notice has been issued to the registered owner/claimant of the vehicle by the District Collector, whether or not the notice has Patna High Court CWJC No.21485 of 2019(2) dt.16-12-2019 been served upon him? (d) If the show cause notice has been served upon the registered owner/claimant, what was the mode of service and on which date the notice was served? (e) If the notice was served upon the registered owner/claimant of the vehicle, whether or not the reply to the show cause notice has been filed? (f) If the reply to the show cause notice has been filed, what is the stage of the confiscation proceeding? (g) If the confiscation proceeding is still pending, by what time the same is likely to be concluded?

22. In case, no counter affidavit would be filed within the time stipulated hereinabove, the court would presume that whatever has been stated in the writ petition are true and correct and would proceed to pass orders in accordance with law after hearing the parties on the basis of the materials available on record.
