JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 2 23-10-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner apprehends arrest in a case registered for the offences punishable under sections 353/504 of the Indian Penal Code. It is alleged that on 04.06.2013 at 12 Noon the informant, Moharir under Forbesganj Municipality, along with retired head clerk cum accountant had asked the petitioner to pay a sum of Rs. 770/- against municipal rent and issued a rent receipt for the month of April. The petitioner, however, paid only Rs. 700/-. It is alleged that the informant insisted upon payment of rest of Rs. 70 which he did not do and allegedly thereafter the petitioner assaulted retired Tax Daroga who came Patna High Court Cr.Misc. No.44199 of 2013 (2) dt.23-10-2013 subsequently. Learned counsel for the petitioner submits that this case has been instituted on 05.06.2013 only because one day prior a case was instituted by this petitioner alleging that informant was demanding a sum of Rs. 500/- illegally, vide Forbesganj PS case No. 185/2013. In view of above, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on his furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Forbesganj P.S. case No. 188/2013, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
