JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 3 25-09-2013 The Court of learned Sub-Judge III, Saharsa in Title Suit No. 63 of 1993 has, by the impugned order dated 22.04.2013, rejected an application seeking abatement of Title Suit No. 63 of 1993 by virtue of Section 4 ( c) of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956 ( hereinafter referred to as the ‘Act’). The petitioners are defendants before the Court below. They have challenged the impugned order on the ground that as per Section 4 ( c ) of the said Act all the proceedings including suits in respect of declaration of rights or interest pending before any Court should abate on issuance of a notification under Section 3(1) of the Act. Mr. Amar Nath Jha, learned counsel for the petitioners contends, assailing the order impugned that the Court 5 below failed to take into account the fact that apart from the relief for setting aside the sale deed, there were other reliefs also prayed for in the plaint and in view of such reliefs sought in the plaint the Court below should have ordered for abatement of suit. From the impugned order it appears that the Court below refused to order for abatement under Section 4( c) of Act on the reasoning that Consolidation Court cannot set aside a sale deed after declaring the same to be illegal, void and not operative and such power vest in the Civil Court only. I do not find any fallacy in such reasoning. The plea that other reliefs had also been sought in the plaint and, therefore, the suit should have been allowed to abate is not acceptable for the reason that other reliefs are apparently consequential to the main relief sought for in paragraph 41 of the plaint for setting aside the concerned sale deed. This is to be noted that a copy of the plaint has been brought on record by way of supplementary affidavit filed on behalf of the petitioners. In view of the above, I do not find any reason to interfere with the impugned order. This application is accordingly, dismissed. (Chakradhari Sharan Singh, J) Arun Kumar/-
