Mr. Brij Nandan Prasad, appears on behalf of the petitioner. State is represented by Mr. Atul Chandra, Additional Public Prosecutor. The occurrence has taken place as back as on 4.7.1997. He remained an absconder for about ten years. Allegation is that he along with other accused persons came variously armed and resorted to firing which has caused death. Having heard learned Counsel for the party and taking into consideration the nature of allegation and material available, I am not inclined to accede to the prayer of the petitioner.
