Learned counsel for the petitioners submits that inadvertently the petition has been filed under Article 227 of the Constitution of India as civil miscellaneous case though the impugned order is against the rejection of application under Order 7 Rule 11 of the Code of Civil Procedure. Against the impugned order, a civil revision under Section 115 of the Code of Civil Procedure is maintainable. Learned counsel seeks permission to convert the present petition into civil revision.
