CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 29-11-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code. It is alleged that the victim was working as domestic help at the crusher machine of Ram Pukar Singh and Briz Kishore Singh @ Kishore Singh where the petitioner was Manager. Subsequently dead body of the victim was recovered from the crusher machine. It is submitted by learned counsel for the petitioner that only charge sheet has been submitted against Umesh Singh whereas the investigation is still pending against the petitioner and others and no evidence has been collected during the course of investigation when the petitioner is not involved in 2 Patna High Court Cr.Misc. No.41009 of 2012 (2) dt.29-11-2012 killing the victim. Moreover, the petitioner denied to be the Manager of Ram Pukar Singh and Briz Kishore Singh @ Kishore Singh. Considering the nature of accusation and investigation is pending against the petitioner, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Sherghati P.S. Case No. 132 of 2005 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U.K./- (Dinesh Kumar Singh, J)
