Versus THE STATE OF BIHAR ----------- 02/ 05-05-2009 As both these cases arise out of the same police station case number, they are heard together. Learned counsel for the petitioners submits that co- accused Anantlal Mahto, Bhogi Yadav, Balbodh Chaudhary, Raju Jha, Jyotish Chaudhary, Phul chandra Jha, Gopal Sah and Raj Kumar Jha having similar allegation to that of petitioners have been allowed anticipatory bail by a Bench of this Court vide Cr.Misc. No.51826 of
2008. Accordingly, both these petitions for anticipatory bail are also allowed. In case of arrest or surrender within one month from today in Babubarahi P.S.Case No.77 of 2007, the above named petitioners in both these cases shall be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand)each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
