01.03.2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor. A plea of insanity has been taken on behalf of petitioner. As such, the learned lower court is directed to proceed in accordance with Chapter–XXV of the Cr.P.C. and will determine the issue, more particularly, in terms of Section 328 and in case he finds the petitioner insane, then in that event the learned court will pass an appropriate order in terms of Section 330 of the Cr.P.C. without being influenced by the earlier orders.
