JUSTICE ARUN KUMAR JHA Mr. Abinash Kumar, Advocate Mr. : : 5 20-06-2025 Learned counsel for the petitioners submits that the ORAL ORDER petitioners have challenged the order dated 29.03.2017 passed by learned Sub-Judge-III, Danapur in Title Suit No. 175 of 2010, whereby and whereunder the learned Sub-Judge-III, Danapur rejected the petition of petitioners dated 13.05.2016 Patna High Court C.Misc. No.1690 of 2017(5) dt.20-06-2025 filed under Order 1 Rule 10(2) of the Code of Civil Procedure.
Learned counsel for the petitioners further submits that the parties of Title Suit No. 175 of 2010 have got a collusive decree in the said case on the basis of their compromise and the subject matter includes the property of the intervenor petitioners. The petitioners have already challenged the compromise decree by filing a Title Suit No. 257 of 2023 and though the present matter has become infructuous, withdrawal simpliciter would affect the right of the petitioners.
In light of submissions made by the learned counsel for the petitioners, the present petition is dismissed as withdrawn with a liberty to the petitioners to raise all the issues in appropriate proceeding before the competent Court.
