Judgment
Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 414, 120B/34 of the Indian Penal Code and Section 4 and 5 of Explosive Substances Act. It is alleged that petitioner's name has surfaced on the statement of Ranjit Kumar and Ajay Singh. The prosecution case is that 75 bags of Amonium Nitrate each weighting 50 kg. was being transported by M/S Modi Explosives, owned of Subhash Prasad and Manager Ashok Modi and the delivery was supposed to be made to one Surajdeo Tiwary. It is submitted that there is notification of the Central Government that Amonium Nitrate can not be treated within ambit of Explosive Substance. Considering the fact that petitioner's name figured in confession of co-accused, let the above named petitioner be released on bail in the event of arrest or surrender in the court below within a period of twelve weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram(M) P.S. Case No. 451/10, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. m.p. ( Dinesh Kumar Singh, J.)
