JUSTICE DINESH KUMAR SINGH) 2 01-02-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered under Sections 33, 41 and 42 of the Indian Forest (Bihar Amendment Act, 1989) Act, 1927. One sand loaded tractor was seized by the forest officials when the driver conveyed the name of Sunil Singh, at whose behest the mining took place. Petitioner is the sole owner of the tractor in question. Considering the fact that the petitioner was not apprehended on the spot and the statement of the driver does not involve him, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two 2 Patna High Court Cr.Misc. No.3029 of 2012 (2) dt.01-02-2012 sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Aurangabad in connection with Forest Case no. 19 of 2009 subject to the conditions as laid down under Section 438(2) Cr.P.C. Anil/- (Dinesh Kumar Singh, J.)
