Counsel appearing on behalf of the State. The petitioner seeks bail in a case which has been registered under Section 379 of the Indian Penal Code regarding theft of the informant’s new vehicle. Submission is that the petitioner is not named in the First Information Report, has not been put on Test Identification Parade. His name has come on the basis of confessional statement of co- accused. Other co-accused persons have faced trial and they have been acquitted. Co-accused Jairam Mahto, Chhathu Mahto, Sonu Kumar and Pintu Sharma have already been granted bail by different orders of this Court. Considering the facts and circumstances of the case, the petitioner Sheo Pujan Sharma is ordered to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (T) P.S.
