Heard learned counsel for the petitioner and the State. There is property dispute in between the parties. They are Gotia. Aunt of the informant is dead. Co-accused Matukdhari is the assailant of the deceased on her head which was found fatal. Petitioner has been alleged for causing assault to other family members that also by means of Lathi. In the discussed facts and circumstances, this petition for anticipatory bail is allowed. In case of arrest or surrender within one month from the date of receipt/production of a copy of this order in Agion (Garhani) P.S.Case No.45/2008, the above named petitioner shall be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Arrah, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
