Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Gopalganj Cyber Police Station Case No. 42 of 2024, disclosing offences under Sections 67, 67(B) of the I.T. Act and Section 14 of the POCSO Act.

As per the FIR, lodged by ASI Cyber Police Station, Gopalganj, based upon the report of Bihar Police Headquarter Economic and Cyber Offences, Patna, dated

30.06.2023, whereby the child pornography has reportedly been uploaded on the social media, facebook, showing video and photos of sexual exploitation of a child aged about 5 to 6 years. Based upon the report, addressed to Superintendent of Police, Gopalganj, along with uploaded videos and photos showing Patna High Court CR. MISC. No.1961 of 2025(2) dt.24-02-2025 child pornography, the case was lodged by the Cyber Cell, Gopalganj, against the petitioner whose involvement was found in the uploading/sharing of porn videos and photos of the minor victim.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and for the last two years, he has been residing in Dubai where the sim attached to the phone does not work. The phone and sim of the petitioner might have been misused by somebody else during his absence.

Having regard to the submissions made on behalf of the parties and taking into consideration the serious nature of allegation and the prima facie involvement of the petitioner in the offence, I am not inclined to grant the petitioner privilege of anticipatory bail.
