ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

to issue an appropriate Writ, order or direction more particularly one in the nature of Mandamus declaring the by issuing the impugned notice through vide ROC No.A/01/2025 dt. 01.10.2025 of the land belonging to the petitioner in Sy. No. 235/7 land admeasuring at an extent of Ac. 4.98 cents situated at Bakarpet Village, Chinagotigalu Mandal, Tirupathi District, and trying to interfere with the peaceful possession and enjoyment of the land without conducting any field inspection or local enquiry and without verifying the correctness of the complaint and without considering the representation submitted by the Petitioner vide dt. 09.10.2025 with all relevant documents as arbitrary, illegal and violative of Articles 14, 21 and 300A of the Constitution of India and against principles of natural justice and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of admeasuring at an extent of Ac. 4.98 cents situated at Bakrapet Village, Chinagotigalu Mandal, Tirupathi District and pass….

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents.

The learned counsel for the petitioner submits that the petitioner, being a landless poor person, was assigned land admeasuring an extent of Ac.4.98 cents in Sy. No.235/7, situated at Bakarpet Village, Chinagotigalu Mandal, Tirupati District, by the respondent authorities after due enquiry in the year 2000. Since then, the petitioner has been in peaceful possession and enjoyment of the subject property for over 25 years. Pattadar Pass Book and Title Deed were also issued in favour of the petitioner by the revenue authorities. While so, the respondent authorities issued a notice dated 01.10.2025 for conducting survey, to which the petitioner submitted his explanation on 09.10.2025. However, without conducting the survey and without passing any orders in accordance with the provisions of law, the respondent authorities are now attempting to dispossess the petitioner from the subject property.

Considering the submissions made by learned counsel appearing on either side, this Court is inclined to dispose of the writ petition, without going into the merits of the case, by directing the respondent authorities to consider the explanation submitted by the petitioner dated 09.10.2025, conduct the survey, and pass final orders after affording an opportunity of hearing to the petitioner. Till such time, the respondent authorities shall not dispossess the petitioner from the subject property.
