ORDER:
The learned counsel for the petitioners submits that the petitioners the siblings of Accused No.1 and the civil disputes are pending relating to the ancestral property between the petitioners and their deceased’s father. It is submitted that the deceased passed away by consuming some poison. It is also submitted that the deceased was aged about 70 years and also not stabled mentally.
It is also further submitted, a crime is registered vide Crime No.73 of 2025 for the alleged offence under Section 108 read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (BNS) against the petitioners also. The learned counsel for the petitioners further submits that the Accused No.2 was arrested on 19.06.2025. It is submitted that on account of family disputes over the ancestral property and on account of emotional outburst, the deceased was consumed poison and passed away. It is further submits that the petitioners are residents of Hyderabad and there they are working and they have absolutely no role in commission of alleged offence.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the State.
The police issued Section 179 of Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS) notice calling upon the petitioners to appear before them t on 21.06.2025. As seen from the notice it was issued on 19.06.2025, but it was served to the petitioner on today i.e., 20.06.2025.
Considering submissions, a direction Investigating Officer/3'^'^ respondent to conduct investigation without taking any coercive steps against the petitioners. The 3'^'’ respondent shall give notice in advance to the petitioners granting them at least a week time for appearance if their presence is required for investigation.
