O R D E R:
This petition is filed under Article 226 of the Constitution of India, seeking the following relief: the Respondent No.5 pertaining to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of respondents more particularly Respondent No 3 in disposing the Revision vide Rc No D1/1915/2024 filed by the petitioner challenging the illegal mutation of revenue records the petitioners property admeasuring an extent of Ac.1-00 cents in Sy.No.237 of Kalavalapudi Village, Venkatagiri Mandal, Tirupati District in favour of Respondent No.6 as illegal, arbitrary, unconstitutional and being violative of Articles 14, 21 and 300-A of the Constitution of India and in contravention to the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and consequently direct the Respondent No 3 to dispose the Revision vide Rc.No.DI/1915/2024 filed by the petitioner in time bound manner”
Though the petitioner made several allegations, during the course of hearing, learned counsel for the petitioner requested this Court to issue a direction to the respondent authorities to dispose of the revision filed by the petitioner before the 3rd respondent without touching the merits.
Learned Government Pleader for Revenue furnished written instructions submitted by the Joint Collector, Tirupati in Roc.D1/1915/2024 dated
24.03.2025, wherein it is stated that the revision petition filed by the writ petitioner has been taken on file vide Roc.D1/1915/2024 and a notice has been issued for both parties to appear before the Joint Collector, Tirupati on
29.03.2025. The enquiry is in progress and the case will be disposed after due inquiry. 3 NV,J W.P.No.7587 of 2025
In view of limited request made by the learned counsel for the petitioner and written instructions dated 24.03.2025 submitted by the 3rd respondent , the 3rd respondent is directed to dispose of the revision filed by the petitioner, in accordance with law, within four (04) months from today. Till disposal of the revision by the 3rd respondent, the respondents are directed not to create third party interest by way of any mode of alienation in respect of the subject property. There shall be no order as to costs.
Consequently, miscellaneous applications pending if any, shall also stand closed.
