junior counsel representing Sri Metta Chandra Sekhara Rao, learned counsel for the respondents. Despite time being granted there is no clarity about the alleged dispute, because of which the power connection has not been granted to the petitioners. Learned counsel for the petitioners on instructions has stated that an indemnity will also be given. He also relies upon the judgment reported in Chandu Khamaru v Nayan Malik and Others1 wherein the Hon’ble Supreme Court of India clearly held that the respondents are bound to supply the electricity even if there is a disputed passage. Hon’ble Supreme Court of India also held that if they find any difficulty they could even open up the street and to ensure electricity supply to the petitioners. Considering the submission made and as there is no clarity about the dispute, this Court is of the opinion that by following the judgment of the Hon’ble Supreme Court of India the Writ Petition should be allowed with a direction to the respondents to ensure that the electric supply should be given to the petitioners within a period of four weeks from the date of receipt of a copy of this order. The petitioners are also 1 (2011) 12 SCC 314 2 directed to furnish the indemnity as required within the said period. With the above direction the Writ Petition is allowed. No costs.
