The Court made the following: ...PETITIONER ...RESPONDENT(S) / THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI CIVIL REVISION PETITION NO: 43812025 ORDER: The petitioner is the plaintiff in O.S.No.107 of 2023 in the Court of Junior Civil Judge at Movva. He filed suit for permanent injunction against the defendants/respondents who are the State and State authorities including Grampanchayat.
2. Learned counsel for the petitioner submits that the petitioner also filed an application for grant of temporary injunction in the suit. He submits that the defendants have filed written statement and have also objection/counter to the interim injunction application but the same is pending and the respondents are threatening to demolish the subject property.
3. Considering the prayer in Civil Revision Petition as also the nature of the dispute, issuance of notice to the respondents is dispensed with. The suit was filed in the year 2023 along with application for temporary injunction. Learned Trial Court ought to have made efforts to expeditiously dispose of the temporary injunction matter.
Consequently, without observing anything on merits of the claim of the plaintiff/petitioner or of the defendants, this Civil Revision Petition is being disposed of finally with a direction to the learned Court to expeditiously dispose of I.A.No.264 of 2023 in O.S.No.107 of 2023 within a period of three (03) months from the date the copy of this order is produced, if there is no other legal impediment. \ No order as to costs.
