HON'BLE SMT. JUSTICE SUMATHI JAGADAM CRIMINAL APPEAL No.69 OF 2019 ADVANCE ORDER:(Per Hon'ble Sri Justice K. Suresh Reddy) In the result, the Criminal Appeal is allowed and the judgment of conviction and sentence, recorded by the learned Metropolitan Sessions Judge-cum-I Additional District and Sessions Judge-cum- Special Judge to try the offences under Protection of Children from Sexual Offences Act, Visakhapatnam, in Sessions Case No.199 of 2016, dated 29.06.2018, under Sections 363 and 376 IPC and Sections 4 and 6 of POCSO Act, is hereby set-aside and the appellant-accused is acquitted accordingly. The appellant-accused is directed to be set at liberty, forthwith, if he is not required in any other case or crime. As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
