#1. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate Writ or order or direction, preferably one in the nature of a Writ of Mandamus declaring the action of the respondents, especially the action of the 4th respondent in calling the petitioner for bind over before the police station is illegal, discriminatory, arbitrary, malafide, in violation of the right of the petitioner and the rights guaranteed under the 14, 21 of the constitution of India“
#2. Heard Sri P.Ranga Rao, learned counsel for petitioner and Sri V.Farook, learned Assistant Government Pleader for Home respondents.
#3. Learned counsel for petitioner would submit that because of political motive, police are calling the petitioner to the police station without any crime being registered.
#4. As against that, learned Assistant Government Pleader for Home for respondents would submit that, a crime is registered in Cr.No.23 of 2021, dated 10.01.2021, for the offence punishable under Section 110(E) of Cr.P.C., of Poduru Police Station of West Godavari District.
#5. Recording the same, the writ petition is disposed of. However, the police are directed to follow due process of law regarding the crime which is registered against the petitioner.
